Matrix Homes – Terms and Conditions

Welcome to Matrix Homes, a digital real-estate and property-management platform owned and operated by Matrix Private Investigations and Security Company (Private) Limited, together with its affiliated and subsidiary companies (“Matrix Group,” “we,” “us,” or “our”).
By accessing or using the Matrix Homes website, mobile applications, APIs, or related services (collectively, the “Platform”), you agree to comply with these Terms and Conditions (“Terms”).
These Terms form a legally binding agreement governed by the laws of the Republic of Zimbabwe and applicable African regional instruments.
1. Legal Basis and Jurisdiction
These Terms are enforced under Zimbabwean and African regional law, including:
Electronic Transactions and Electronic Commerce Act [Chapter 8:20]
Cyber and Data Protection Act (2021)
Data Protection Act [Chapter 11:12]
Consumer Protection Act [Chapter 14:44]
Matrix Homes also adheres to the African Union Convention on Cyber Security and Data Protection (Malabo Convention) and international frameworks such as GDPR (EU) and Google API Services Policy.
2. Ownership and Corporate Structure
Matrix Homes is a business division of Matrix Private Investigations and Security Company (Pvt) Ltd, registered in Harare, Zimbabwe, and operating across Africa through its subsidiaries and child companies.
All legal obligations, intellectual property rights, and liabilities of the Platform are held by the Matrix Group.
3. Definitions
Matrix Agent – An in-house employee of Matrix Private Investigations and Security Company (Pvt) Ltd or its subsidiaries, authorized to inspect, verify, and list properties.
Agency – A third-party verified real-estate company licensed to advertise through Matrix Homes by purchasing membership or listing packages.
Seller – A property owner submitting property details to Matrix Homes for verification and listing via Matrix Agents.
Buyer / User – A member of the public using the Platform to browse, inquire, or contact Agencies or Matrix Agents.
Listing – A property verified and published by Matrix Agents or licensed Agencies.
4. Eligibility and Access
Only verified Agencies may purchase memberships or paid packages.
Matrix Agents are internal personnel; impersonation is strictly prohibited.
Buyers, sellers, or general users may not purchase memberships or listing packages.
All users must be 18 years or older and provide truthful information.
Matrix Homes reserves the right to approve, restrict, or terminate accounts.
5. Property Submission and Verification
Sellers cannot list directly. Properties must be submitted to Matrix Homes for inspection.
A Matrix Agent will physically verify location, ownership documents, and authenticity before listing.
Only verified properties are published on the Platform.
Matrix Homes reserves the right to reject or delist properties that fail verification or breach laws.
6. Membership and Payments
Memberships and paid listings are reserved exclusively for third-party Agencies.
Matrix Agents operate under Matrix Homes; they do not pay for memberships.
Buyers and the general public are not permitted to purchase memberships or subscription plans.
Payments are processed via approved gateways in line with Reserve Bank of Zimbabwe (RBZ) e-commerce and AML regulations.
Fees are non-refundable except where required by the Consumer Protection Act.
Pricing and packages may be updated with prior notice.
7. Impersonation and Fraud
Impersonating a Matrix Agent or Agency constitutes fraud and identity theft.
Such acts will result in immediate account termination and criminal prosecution under the Criminal Law (Codification and Reform) Act [Chapter 9:23] and the Cyber and Data Protection Act (2021).
Matrix Group cooperates with Zimbabwe Republic Police and international law-enforcement agencies for investigation and prosecution.
8. System Availability and Third-Party Dependencies
The Platform relies on internet infrastructure and third-party services (hosting, cloud networks, Google APIs, Meta Login, Paynow, Visa, etc.).
Matrix Homes strives for uptime but cannot guarantee uninterrupted service.
Downtime or limited access may occur due to external system failures, maintenance, or network outages.
Matrix Homes shall not be liable for loss or damage arising from such events but will communicate major disruptions transparently.
9. User Conduct
Users must:
Use the Platform lawfully and in good faith.
Not post or share false, defamatory, or misleading information.
Not engage in spamming, scraping, or data mining.
Respect privacy, copyright, and proprietary data.
Avoid tampering, hacking, or exploiting vulnerabilities.
Violations may lead to immediate suspension, banning, and legal action.
10. Intellectual Property
All software, designs, logos, and data belong to Matrix Private Investigations and Security Company (Pvt) Ltd and its affiliates.
Agencies retain ownership of their own listing materials but grant Matrix Homes a worldwide, royalty-free licence to display and promote them.
Unauthorized use, copying, or redistribution is prohibited.
11. Data Protection and Privacy
Matrix Homes processes personal data under the Data Protection Act (2021), Cyber and Data Protection Act, and GDPR.
Data are stored securely and accessed only for legitimate business purposes.
Users may request data correction or deletion by emailing matrixhomesagency@gmail.com.

12. Third-Party Integrations
Matrix Homes integrates with external providers (Google Maps, Facebook Login, analytics, payment gateways).
Their independent terms apply. Matrix Homes is not liable for failures, outages, or breaches arising from third-party systems.
13. Limitation of Liability
Matrix Homes acts as a digital intermediary, not as a real-estate broker or financial advisor.
Property information is provided by Agencies or verified Matrix Agents but may change without notice.
Matrix Homes shall not be liable for:
Loss of profits, business, or goodwill;
System downtime or third-party outages;
Actions or omissions of Agencies, buyers, or sellers.
Users access the Platform at their own risk.
14. Consumer Rights and Transparency
Matrix Homes upholds fairness and disclosure consistent with Zimbabwe’s Consumer Protection Act and African consumer-rights frameworks.
Refunds, dispute resolution, and data-handling requests are processed transparently and in good faith.
15. Dispute Resolution
Disputes are first resolved through mediation.
Failing that, disputes are referred to binding arbitration under the Arbitration Act [Chapter 7:15], seated in Harare, Zimbabwe.
Arbitration shall be conducted in English; the arbitrator’s decision is final and enforceable in all African jurisdictions recognizing Zimbabwean awards.
16. Amendments
Matrix Group may revise these Terms to comply with new legislation or technical changes.
Updates will be published on the Platform and become effective upon posting. Continued use constitutes acceptance.
