1. Introduction
These Terms and Conditions (“Terms”) govern the relationship between Matrix Homes (“Matrix”, “we”, “our”, “us”) and you, the property owner (“Seller”, “Owner”, “Client”) who lists a property for rent or sale on MatrixHomesZW.com.
By submitting, listing, or advertising any property on our platform, you agree to be bound by these Terms.
2. Eligibility to List a Property
To list a property on MatrixHomesZW.com, you confirm that:
- You are the legal owner of the property or have full written authorization to represent the legal owner.
- All information you provide (property details, documents, pricing, and photos) is accurate and truthful.
- You have the legal right to rent out or sell the property under Zimbabwean law.
3. Listing Verification
All property listings submitted to Matrix are subject to:
- Review
- Verification
- Approval
Matrix reserves the right to request supporting documents (e.g., proof of ownership) and to reject or remove listings that do not meet our standards or legal requirements.
4. Matrix Commission Structure
4.1 Rental Properties
If you list your property for rent, you agree that:
- Matrix will charge 50% of the first month’s rental amount only as a commission.
- This commission becomes payable immediately upon successful placement of a tenant sourced through Matrix.
Example:
If the property is rented for USD $500/month, Matrix receives $250 once, and all future rental payments belong entirely to the owner.
4.2 Properties for Sale
If you list your property for sale, you agree that:
- Matrix will charge 5% of the final selling price upon the successful sale of the property.
- This commission becomes payable at the moment the sale is concluded and payment is received.
Example:
If the property sells for USD $100,000, Matrix receives $5,000.
4.3 When Commission Is Due
Commission is considered earned and must be paid when:
- A buyer or tenant signs an agreement facilitated by Matrix
- Payment for rent or purchase is made
- Matrix was the source or facilitator of the client
Matrix will issue an invoice for the amount owed.
5. Seller Responsibilities
You agree to:
- Provide honest, complete, and updated information.
- Notify Matrix of changes to property availability.
- Allow Matrix to advertise the property on its platform and partner networks.
- Ensure the property complies with legal rental or sale requirements.
6. No Direct Bypass of Matrix
By listing on MatrixHomesZW.com, you agree not to bypass Matrix by engaging with a tenant or buyer introduced through Matrix without paying the required commission.
Matrix reserves the right to seek legal remedies if bypassing occurs.
7. Media & Marketing Rights
You grant Matrix permission to:
- Market the property
- Use photos, descriptions, and videos
- Publish the listing across websites, social media, and partner networks
This right is non-exclusive and lasts for as long as the property is listed on the platform.
8. Property Accuracy & Liability
The owner is fully responsible for ensuring that all property details are accurate and legal.
Matrix is not liable for:
- Misrepresented property information
- Disputes arising between the seller and buyer/tenant
- Loss, damage, or legal issues related to the property
9. Removal of Listings
Matrix reserves the right to remove any listing:
- If information is inaccurate
- If the property is no longer available
- If the owner violates these Terms
The owner may also request removal at any time.
10. Amendments to Terms
Matrix may update these Terms from time to time. Updated Terms will be posted on MatrixHomesZW.com, and continued use of the platform constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of Zimbabwe. Any disputes shall be resolved under Zimbabwean jurisdiction.
12. Acceptance
By listing or continuing to list a property on MatrixHomesZW.com, you confirm that you have read, understood, and agreed to these Terms and Conditions.
